Tenth Circuit Reviewing NCAA Stay Request as Class of 2022 Fifth Year Eligibility Remains Active
A federal district court injunction granting a fifth season of eligibility to NCAA Division I athletes who completed four years in 2025-26 remains in effect while the Tenth Circuit considers an emergency stay request. Judge Charlotte Sweeney denied the NCAA's own stay motion on Aug. 10, finding the NCAA failed to meet its burden on likelihood of success and irreparable harm. The appellate court's decision will determine whether thousands of class-of-2022 athletes can compete this season, with the NCAA's reply brief due Aug. 17 and no ruling issued as of the Aug. 16 research cutoff.
