Federal Court Grants Transgender Troops Class Action Status
A federal judge certified a class of up to 15,000 transgender service members and recruits in Talbott v. USA, meaning any trial verdict will bind the U.S. government across the entire group rather than just the original plaintiffs. The D.C. Circuit has already partially upheld an injunction protecting currently serving members while allowing the ban on new enlistees to stand, and a merits proceeding is scheduled for January 2027. The outcome will hinge largely on whether the Supreme Court's Skrmetti decision forces the court to apply a lower standard of review, a question both sides are now briefing.
